Lincoln understood Herndon to be proposing that the President, on their own initiative and judgment, was entitled to preemptively invade another country to repel an anticipated invasion. Herndon felt this principle justified Polk's sending of troops into disputed territory, which led to the Mexican-American War (1846-1848), though Polk didn't justify his actions in that way.

This led to large protests and an abolitionist riot at the Boston Courthouse, requiring Federal troops and state militia to ensure Burns' transport to a ship sailing to Virginia. <br><br>

In context, Thoreau is arguing the quality of a higher law, higher than the Fugitive Slave Law or Constitutional legalism from the courts --  the "law of humanity," which condemns the injustice of slavery.

This amendment supplies that defect, and allows Congress to correct the unjust legislation of the States, so far that the law which operates upon one man shall operate equally upon all. Whatever law punishes a white man for a crime shall punish the black man precisely in the same way and to the same degree. Whatever law protects the white man shall afford equal protection to the black man. Whatever means of redress is afforded to one shall be afforded to all. Whatever law allows the white man to testify in court shall allow the man of color to do the same. These are great advantages over their present codes.</p>

			<content:encoded><![CDATA[<p>The most important factor in getting the right spirit in my Administration, next to the insistence upon courage, honesty, and a genuine democracy of desire to serve the plain people, was my insistence upon the theory that the executive power was limited only by specific restrictions and prohibitions appearing in the Constitution or imposed by the Congress under its Constitutional powers. My view was that every executive officer, and above all every executive officer in high position, was a steward of the people bound actively and affirmatively to do all he could for the people, and not to content himself with the negative merit of keeping his talents undamaged in a napkin. I declined to adopt the view that what was imperatively necessary for the Nation could not be done by the President unless he could find some specific authorization to do it. My belief was that it was not only his right but his duty to do anything that the needs of the Nation demanded unless such action was forbidden by the Constitution or by the laws. Under this interpretation of executive power I did and caused to be done many things not previously done by the President and the heads of the departments. I did not usurp power, but I did greatly broaden the use of executive power. In other words, I acted for the public welfare, I acted for the common well-being of all our people, whenever and in whatever manner was necessary, unless prevented by direct constitutional or legislative prohibition.</p>

But in cases involving the Federal Constitution, where correction through legislative action is practically impossible, this court has often overruled its earlier decisions. The court bows to the lessons of experience and the force of better reasoning, recognizing that the process of trial and error, so fruitful in the physical sciences, is appropriate also in the judicial function.</p>

In the Proceedings of the <a href="https://www.google.com/books/edition/Proceedings_Annual_Convention/0-pRAQAAMAAJ?hl=en&gbpv=1&bsq=johnson+%22men+of+state+and+faith+in+the+Supreme+Being%22&dq=johnson+%22men+of+state+and+faith+in+the+Supreme+Being%22&printsec=frontcover">Illinois State AFL-CIO Convention (1968)</a>, there is (a) a reference to a note that the state president of the AFL/CIO, Reuben G. Soderstrom, attending the <em>16th</em> such Prayer Breakfast, and then (b) a passage on the next page "U. S. President Lyndon B. Johnson's statement to a tremendous audience contained the following comment:"<br><br>

<blockquote>Our Constitution separates church and state. We know that separation is a source of our system's strength, but the conscience of our nation does not call for separation between men of state and faith in the Supreme Being.</blockquote><br>

Johnson does not appear to have included this text in <a href="https://www.presidency.ucsb.edu/documents/remarks-the-presidential-prayer-breakfast-3">his speech at the 16th Presidential Prayer Breakfast</a>, nor does he appear to have gone to the 1968 Illinois AFL/CIO convention. Is this an odd paraphrase of the comments from four years earlier? Did Johnson speak the above in another venue that was also quoted in the Illinois AFL/CIO Convention proceedings? Is this paraphrase actually what he said in 1964, regardless of the written record of his comments?<br><br>

While that shorter quote, or further paraphrases of it, are easy to find in quotation collections online, I can find no citation associated with it.<br><br>						</span>

For more than 20 years I have endeavored &#8212; indeed, I have struggled &#8212; along with a majority of this Court, to develop procedural and substantive rules that would lend more than the mere appearance of fairness to the death penalty endeavor. Rather than continue to coddle the Court&#8217;s delusion that the desired level of fairness has been achieved and the need for regulation eviscerated, I feel morally and intellectually obligated simply to concede that the death penalty experiment has failed. It is virtually self-evident to me now that no combination of procedural rules or substantive regulations ever can save the death penalty from its inherent constitutional deficiencies. The basic question &#8212; does the system accurately and consistently determine which defendants &#8220;deserve&#8221; to die? &#8212; cannot be answered in the affirmative. [&#8230;] The problem is that the inevitability of factual, legal, and moral error gives us a system that we know must wrongly kill some defendants, a system that fails to deliver the fair, consistent, and reliable sentences of death required by the Constitution.</p>

Efficiency may be a political virtue, but only if strictly limited. Our Constitution, by its separation of powers and its system of checks and balances, acts as a restraint upon efficiency by denying exclusive power to any branch of government. The logic of governmental efficiency, unchecked, runs straight on, not only to dictatorship, but also to torture, assassination, and other abominations.</p>

The only problem was, the founders left a lot of people out of the Constitution. They left out poor people and black people and female people. It is possible to read the history of this country as one long struggle to extend the liberties established in our Constitution to everyone in America. And it still goes on today.</p>

This <a href="https://allthingsliberty.com/2021/05/massachusettensis-and-novanglus-the-last-great-debate-prior-to-the-american-revolution/">series of essays</a> was written by Adams under the pseudonym of "Novanglus" (Latin for "New England") responding to essays from his past friend Daniel Leonard as "Massachusettensis" on colonial leadership and what the proper relationship was between the American colonies and Britain.<br><br>
